Terms of Service

§ 1 Scope

These Terms of Service apply to the use of the web-based application "Mandat" (hereinafter "Service"), operated by [PROVIDER NAME] (hereinafter "Provider"). By registering for and using the Service, the user accepts these Terms of Service.

§ 2 Description of Services

Mandat is software designed to support works council activities. The Service includes, in particular:

  • Management of works council meetings and agendas
  • Conducting and documenting votes
  • Generation of meeting protocols
  • Management of decisions and tasks
  • Member management and attendance tracking

§ 3 Registration and User Account

Use of the Service requires registration. The user is obligated to provide truthful information during registration and to keep their login credentials confidential.

The user is liable for all activities carried out through their user account, unless they can prove that misuse by third parties occurred without their fault.

§ 4 User Obligations

The user agrees to:

  • Use the Service only for lawful purposes related to works council activities
  • Not upload content that violates applicable law
  • Keep their login credentials secret and protect them from third-party access
  • Immediately notify the Provider if there are indications of misuse of their account

§ 5 Availability

The Provider strives for an annual average availability of 99.5%. Excluded from this are scheduled maintenance and outages beyond the Provider's control (force majeure, third-party service disruptions).

§ 6 Data Protection

The protection of personal data is of particular concern to the Provider. For details on data processing, please refer to our Privacy Policy.

§ 7 Liability

The Provider is liable without limitation for intent and gross negligence. In cases of slight negligence, the Provider is only liable for breaches of essential contractual obligations (cardinal obligations) and limited in amount to the foreseeable, typically occurring damage.

The above limitations of liability do not apply to damages resulting from injury to life, body, or health.

§ 8 Term and Termination

The usage agreement is concluded for an indefinite period. Either party may terminate the agreement at any time with 30 days' notice to the end of the month. The right to extraordinary termination for good cause remains unaffected.

§ 9 Changes to Terms

The Provider reserves the right to amend these Terms of Service with effect for the future. The user will be informed of changes by email. If the user does not object within 30 days of receiving the notification of changes, the amended Terms are deemed accepted.

§ 10 Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall not be affected.
